Carabellezza.com General Terms and Conditions
These general terms and conditions of sale govern all relations between SAS EC, a company with a share capital of € 2000 whose registered office is Place dit Pietra-Rossa, 20600 Bastia, registered at BASTIA S.C.R. under No. 843 739 129, VAT No. (FR55831647912), hereinafter “Cara Bellezza”, and customers of www.carabellezza.com

A telephone number that is not overtaxed is communicated by email after ordering.
Prior to any transaction, the customer acknowledges having read these terms and conditions and expressly declares to accept them when he clicks on the “Order” button.
Article 1: Special conditions of sale
The customer acknowledges having taken note, at the time of ordering, of the specific conditions of sale set out on screen (name, price, quantity, colour, product characteristics, cost of services) and expressly declares his unreserved acceptance of these.
Article 2: Validity of the order
When placing an order, the customer must select the selected products, add them to his basket indicating the selected products and the desired quantities. The Customer has the possibility to check the details of his order and its total price, and to return to the previous pages to possibly correct the contents of his basket, before validating it.
The contractual information relating to the order (including the order no. in particular) will be confirmed by e-mail.
Any email that is sent to the customer as part of an order will be sent to the email address that the customer uses to identify himself in his customer space.
SAS EC reserves the right not to validate the customer’s order for any legitimate reason, in particular if:
The customer would not comply with the General Conditions in force at the time of his order;
The customer’s order history shows that amounts remain due on previous orders;
One of the customer’s previous orders is the subject of a dispute being processed;
The customer did not respond to a request from Cara Bellezza for confirmation of his order.
The information communicated by the customer during the placing of the order (in particular name and delivery address) binds the customer. As such, Cara Bellezza’s liability cannot in any way be sought in the event that an error in placing the order would prevent ordelay.
The Customer declares that he has the full legal capacity to engage under these Terms and Conditions.
Registration is open to competent adults and minors on condition that they intervene under the supervision of the parent or guardian holding parental authority. In no case is registration authorized on behalf of third parties unless it is validly authorized to represent it (legalentity for example). Registration is strictly personal to each Customer.
In the event of default by the Customer to any of the provisions of this Agreement, Cara Bellezza reserves the right to terminate the account of said Customer without notice.
Article 3: Registration and confirmation of the order
Cara Bellezza confirms receipt of an order by e-mail entitled «Confirmation of your order».
The sale will not be concluded until the confirmation of the order by Cara Bellezza, in an e-mail entitled “Shipping your order”, which will be sent to the customer no later than three business days after registration of the order.
Cara Bellezza reserves the right to not confirm an order for any reason whatsoever, due in particular to the availability of products, an issue regarding the order received, an abnormal order, a foreseeable problem concerning the delivery to be made, or a dispute relating to a previous order.
In this case, Cara Bellezza will inform the customer no later than 6 working days after registration of the order, and will proceed without delay to refund the customer.
In case of unavailability of one of the products of an order, the rest of the order is dispatched.
Article 4: Prices
Cara Bellezza reserves the right to change its prices at any time but undertakes to apply the rates in force that will have been indicated at the time of placing of order, subject to their availability on that date.
Article 5: Payment terms and security
Payment is made by credit card on a secure bank server or using a PayPal account.
Credit card coordinates are encrypted using SSL (Secure Socket Layer) and never pass uncrypted over the network.
Payment is made directly via the 100% secure French operator STRIPE.
Cara Bellezza has no access to these coordinates, and does not keep them on its servers.

Article 6: Reservation of ownership
The products remain the property of Cara Bellezza until the full receipt of the order.
Article 7: Terms and conditions of delivery
A maximum of 5 working days after order registration may be required to ship the order, excluding special operations and holidays. The ordered product is sent via the postal circuit, Colissimo, Chronopost or Relais-Parcel, to the delivery address indicated by the customer. Deliveries to Corsica are made only by Colissimo.
The customer has 14 days to return his parcel. In case of withdrawal, the products sold can be exchanged.
Article 8: Right of withdrawal
A «Return Request» which details the procedure to follow for the return of the products, is delivered with each order. provided that they are returned in their original condition and packaging, and accompanied by the Completed “Request for Return”. Under no circumstances should the swimsuits be worn.
If this period of fourteen clear days normally expires on a Saturday, a Sunday or a public or non-working day, it shall be extended until the first following working day.

Items sold or stored may be subject to an asset. In France, in case of withdrawal, Cara Bellezza will reimburse the costs of sending the products to and from France, the return costs remain the responsibility of the customer. Shipping and return costs abroad are the responsibility of the customer.
Withdrawal Form – Art. R. 121-2.1

The customer will be refunded the amount of the returned item, after receipt of the product by Cara Bellezza, within 14 days, by transfer.
*We do not refund on the sale items. Return orders are paid for by the customer.
Article 9: Provisions of the “Data Protection” Act
Cara Bellezza reported the file containing personal data relating to customers at www.carabellezza.com to the Commission Nationale Informatique et Libertés (Declaration No. 1235194 in accordance with the provisions of the French Data Protection Act of 6 January 1978.
Under this law, the customer has a right of access, rectification or opposition to the personal data collected concerning him.

Article 10: Intellectual Property
Customer can not copy or download any or all of the content from www.carabellezza.com, except with the prior express consent of Cara Bellezza, who remains the only owner of all the intellectual property rights relating thereto.
Article 11: Applicable law
These general conditions of sale are subject to French law.
